    Should I Attend my Workers’ Compensation Hearings?

    Answer:

    We have always as a practice kept our clients apprised of when their claims were going to appear before the arbitrator at the Workers’ Comp Commission. Many of the appearances are proforma. The claim is up; we inform the arbitrator of what’s going on with the case. This continues usually for 90 days while other activities take place in the case.

    It’s generally not required for our client to miss work, come in, and attend a hearing where effectively, nothing substantive is going to happen. There are times when we would require our client to be there, specifically when he’s going to, or she is going to testify, or we want them there to hear the proceedings of a contested motion, but we’ll give our client plenty of notice in advance and let them know when they should be there.
