Can I Sue my Employer or Coworker for Causing my Injury or Illness?Answer:
We often get called from clients, potential clients, who want to talk about what happened at work. It often surrounds a case where they feel that there were unsafe conditions that caused their injury. They feel like their employer is responsible not just for paying Workers’ Comp benefits. They want to know is there anything we can do. Unfortunately for us, or fortunately depending on how you look at it, one of the trade-offs that the Workers’ Compensation Act and statute made over 100 years ago was to remove liability and make it a no-fault statute. What we also did at the same time was made workers’ comp the exclusive remedy for any injuries that occur on the job site. Your employer, your co-worker who’s considered an agent, they have no liability for a work-related injury. There are a few extreme exceptions. Those include when an employer or a co-worker is guilty of an intentional tort against you. One case that we represented involved a young lady who was actually raped by her employer.
