I Have Been Approached to Consider Settling My Claim. What Do I Do?Answer:
When we’re talking to somebody who has called us from the Naperville area about a workers’ comp claim, many times, we’ll be talking to somebody whose claim has been going on for several months or maybe even a year. It’s coming close to the time when they anticipate that it might be settled. One of the things they say to us is, “I think I’ll just sit back and wait and see if the insurance company offers something rather than retain counsel.”
We always caution them. When you do that, you’re probably leaving money on the table. What most people don’t realize is once an insurance company makes a written offer to you, an attorney in Illinois is forbidden from receiving a fee on that part of an offer. If he were to be involved in representing you going forward, he would only be able to obtain a fee on the portion after that he settles the case for. Personally, we don’t do that. If you’ve obtained an offer on your own, it’s not a case that our firm would be interested in.
My message really is you’re hurting yourself by doing that. You’re not helping yourself by going down that path on your own. If you want to obtain a maximum settlement, get a lawyer who knows what they’re doing involved in your case early on and let them handle it through the end. That’s how you’ll do your best.
