    Question:

Am I Eligible Even If My Work Injury Was My Own Fault?

video featuring workers' compensation attorney Phil Turcy

    Answer:

We were called by a gentleman out in Naperville last week. His question to us was we were doing a job; he was a carpenter. They were improperly handling some material. He sustained a really bad cut. He admitted to us that he felt that he was at least partly at fault and wanted to know if he could pursue a workers’ comp claim. Since the statute has been enacted in Illinois in 1913, it’s a no-fault statute. What that means is that even if an employee is partially or entirely at fault for his own injury, he still has a compensable claim. If you have a question about whether your claim is compensable even though you might be partially or wholly at fault, give us a call. Let’s discuss. We think we can help you.
