In Illinois, even if you have a preexisting condition and you are injured in a subsequent accident, it is still compensable under the law. We call that an aggravation of a preexisting condition. In other words, if you have an existing medical condition and you are in an accident, and you have now aggravated that preexisting condition, the person or company that injured you is still responsible for that aggravation.
