    We were asked by someone in Naperville the other day, who had been in an accident but also had a preexisting injury that predated the accident itself, “Is that going to impact or affect my ability to pursue a case?” The short answer is no. In Illinois, even if you have a preexisting condition and you are injured in a subsequent accident, it is still compensable under the law. We call that an aggravation of a preexisting condition. In other words, if you have an existing medical condition and you are in an accident, and you have now aggravated that preexisting condition, the person or company that injured you is still responsible for that aggravation.
