What Damages Am I Entitled to Pursuant to My Defective Product Claim?Answer:
If you believe that you’ve been injured because of a defective product, and that took place in the state of Illinois, you’re entitled to four distinct elements of damages. In other words, there are four different things that must be considered in making sure that you are made whole for the injury that you suffered.
The first one is your medical bills. The company that manufactured, designed, or distributed the product that injured you is responsible to pay all of your past and future medical care because of your injury. Secondly, you’re entitled to any wages that you’ve lost. In other words, did you miss time from work because of the injury that you suffered due to the defective product? If you did, you’re entitled to be compensated for all that lost time and benefits.
Third, you’re entitled to what’s called pain and suffering, in other words, the pain and suffering that you suffered from the day you were injured by the defective product, all the way up into the future. Last, you’re entitled to something called disability. You’re entitled to be compensated for the time that you were disabled or unable to do the things of your normal life while recovering from the injuries you suffered because of the defective product.
